End User License Agreement (EULA)

This End User License Agreement is a legal agreement between you and the developer of FocusMind. By downloading, installing, or using the app, you agree to be bound by its terms.

1. License grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use FocusMind on any device you own or control, for your own personal, non-commercial use.

2. Restrictions

You may not: sell, rent, lease, redistribute, or sublicense the app; copy, decompile, reverse engineer, disassemble, or attempt to derive the source code, except to the extent applicable law expressly permits; remove or alter any proprietary notices; or use the app to build a competing product.

3. Ownership

The app and all intellectual property rights in it remain the property of its developer. This Agreement does not transfer any ownership rights to you -- only the limited license described above.

4. Scope of license (single device / family sharing)

This license permits you to use the app on any device you own or control, and on devices belonging to other users of the same Apple ID family, in each case consistent with the usage rules of the applicable app store (App Store or Google Play).

5. Maintenance and support

We provide reasonable effort support at the contact address below, but have no obligation to provide any maintenance or support for the app. For iOS: Apple has no obligation whatsoever to furnish any maintenance or support services for the app.

6. Warranty

The app is provided "as is" without warranty of any kind. To the extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. For iOS: in the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the app.

7. Product claims

We, not Apple or Google, are responsible for addressing any claims relating to the app or your possession and/or use of it, including: (i) product liability claims; (ii) any claim that the app fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

8. Intellectual property claims

In the event of any third-party claim that the app or your possession and use of it infringes that third party's intellectual property rights, we, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

9. Legal compliance

You represent and warrant that you are not located in a country subject to a government embargo, and are not on any government list of prohibited or restricted parties.

10. Third-party beneficiary

You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of this Agreement, and that, upon your acceptance, Apple has the right to enforce this Agreement against you as a third-party beneficiary.

11. Termination

This license is effective until terminated. It terminates automatically, without notice, if you fail to comply with any of its terms. Upon termination, you must stop all use of the app and delete it from your devices.

12. Limitation of liability

To the maximum extent permitted by applicable law, in no event will we be liable for any special, incidental, indirect, or consequential damages arising out of or related to your use of, or inability to use, the app.

13. Governing law

This Agreement is governed by the laws of Vietnam, without regard to its conflict-of-law provisions, except where applicable app store distribution terms require otherwise.

14. Entire agreement

This Agreement, together with the Terms of Use and Privacy Policy, constitutes the entire agreement between you and us regarding FocusMind, and supersedes any prior agreements.
